Trump FCPA Pause Ups LatAm Corruption Risk

Latin America accounted for 40% of FCPA cases and 50% of fines and penalties.

President Donald Trump’s decision to pause the US Foreign Corrupt Practices Act (FCPA) will drive up corruption risk in Latin America, experts warn.

“Given a history of positive impact associated with the FCPA in Latin America, pausing enforcement could have the effect of driving up bribery and fraud risk in the region,” says Matteson Ellis, who founded and leads Miller & Chevalier’s Latin America practice and is the leading expert on FCPA and Latin America.

However, there will likely be more focus on corruption linked to drug cartels in Mexico, which could impact companies operating in conflict areas in Mexico and Central America, he points out.
